What makes Scotland different

On top of the 6 bank holidays shared across the UK, Scotland has 2nd January on Monday 4 January, the Summer bank holiday on Monday 2 August and St Andrew’s Day on Tuesday 30 November.

Easter Monday is not a bank holiday in Scotland, and the summer bank holiday is on the first Monday of August rather than the last.

Many Scottish employers follow their council’s local public holidays instead of some of these dates, so check your council’s list before you set the rota.

Bank holidays and annual leave

Your staff have no statutory right to a day off on a bank holiday. Under the Working Time Regulations 1998, most workers are entitled to 5.6 weeks of paid holiday a year, capped at 28 days, and you can choose to count bank holidays as part of it.

The law sets no extra rate for bank holiday work either. What you pay, or the day off you give in return, depends on the contract. Recording those hours like any other shift helps you pay what you agreed and show it if anyone asks.
